SASCA Terms and Conditions Policy (UK Compliant)

1. Introduction

These Terms and Conditions govern participation in SASCA programmes, activities, events, and services. By enrolling in or engaging with SASCA, participants and/or their parents or guardians agree to comply with this policy.

This policy is intended to align with applicable UK legislation, including the Consumer Rights Act 2015 and the UK General Data Protection Regulation (UK GDPR) and Data Protection Act 2018.

2. Definitions

  • "SASCA" refers to the organisation delivering performing arts training and activities.

  • "Participant" refers to any individual enrolled in SASCA programmes.

  • "Guardian" refers to a parent or legal guardian of a participant under 18.

  • "Designated Safeguarding Lead (DSL)" refers to the appointed individual responsible for safeguarding and welfare.

3. Eligibility and Registration

Participants must:

  • Provide accurate and complete registration information

  • Meet any age or experience requirements specified for programmes

  • Ensure all required forms, including consent and medical information, are completed prior to participation

SASCA reserves the right to refuse or cancel a registration where information is incomplete or inaccurate.

4. Code of Conduct

All participants are expected to:

  • Treat others with respect, dignity, and inclusivity

  • Follow instructions from staff and facilitators at all times

  • Refrain from disruptive, unsafe, or inappropriate behaviour

This includes (but is not limited to):

  • Bullying, harassment, or discrimination of any kind

  • Inappropriate use of social media relating to SASCA, staff, or other participants

  • Use of offensive language or behaviour

  • Filming or sharing content without permission

SASCA reserves the right to suspend or remove any participant whose behaviour compromises safety, wellbeing, or the effective delivery of services.

5. Safeguarding and Welfare

SASCA is committed to safeguarding and promoting the welfare of all participants.

This includes:

  • A clearly identified Designated Safeguarding Lead (DSL)

  • Appropriate supervision ratios

  • Staff trained in safeguarding practices

All safeguarding concerns must be reported immediately to the DSL or a member of staff.

6. Payments, Cancellations and Consumer Rights

  • All fees must be paid in advance unless otherwise agreed.

Under the Consumer Contracts Regulations 2013, where bookings are made online or at a distance, you may have a 14-day cooling-off period. However, by booking a programme that begins within this period, you acknowledge and agree that the right to cancel may be reduced or lost once services have started.

Cancellation policy:

  • More than 14 days before start date: full credit or partial refund may be offered

  • 7–14 days before start date: partial credit may be offered

  • Less than 7 days before start date: no refunds or credits

Exceptional circumstances may include:

  • Serious illness or injury preventing participation (evidence may be required)

  • Family emergency, including bereavement

  • Relocation making attendance no longer possible

  • Significant timetable changes made by SASCA that prevent attendance

  • Cancellation of sessions or programmes by SASCA where no suitable alternative is offered

All decisions regarding refunds, credits, or transfers are made at SASCA’s discretion, in line with UK consumer law.

SASCA will provide services with reasonable care and skill, as required under the Consumer Rights Act 2015.

7. Attendance and Punctuality

Participants are expected to:

  • Attend sessions regularly and arrive on time

  • Inform SASCA in advance of any absences where possible

Repeated lateness or absence may affect continued participation and eligibility for performances.

8. Health and Safety

Participants must:

  • Disclose any medical conditions, injuries, or additional needs

  • Follow all health and safety instructions provided by staff

SASCA is not responsible for injuries resulting from failure to follow guidance or disclose relevant information, except where liability cannot be excluded under UK law.

9. Media and Recording

SASCA may capture photos or videos for promotional and educational purposes.

Consent will be obtained in advance, and participants have the right to withdraw consent at any time.

Participants are not permitted to film, photograph, or record sessions or performances without prior permission.

10. Intellectual Property

All choreography, scripts, recordings, and creative material developed within SASCA remain the property of SASCA unless otherwise agreed in writing.

Participants:

  • May not reproduce, share, or distribute material externally without written permission

  • May not post performance content publicly without approval

SASCA reserves the right to use recordings and materials for promotional, educational, and archival purposes.

11. Auditions and Selection (if applicable)

SASCA may require auditions or assessments for certain programmes, performances, or opportunities.

  • Selection decisions are final

  • Not all participants are guaranteed performance roles

  • Casting decisions are based on suitability, skill level, and programme requirements

12. Cancellations and Changes by SASCA

SASCA reserves the right to:

  • Modify schedules, staff, or venues where necessary

  • Cancel sessions due to unforeseen circumstances

Where services are cancelled, SASCA will offer a suitable alternative, credit, or refund where appropriate.

13. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.

Subject to this:

  • Participation is at the individual’s own risk

  • SASCA is not liable for loss or damage to personal belongings

14. Complaints Procedure

Complaints should be submitted in writing and will be handled fairly and promptly.

If a complaint cannot be resolved internally, participants may seek advice from relevant consumer advice services.

15. Data Protection (UK GDPR)

SASCA processes personal data in accordance with the UK GDPR and Data Protection Act 2018.

Lawful Basis

Personal data is processed on the basis of:

  • Contractual necessity (to deliver services)

  • Legal obligations

  • Legitimate interests (e.g. administration and safeguarding)

  • Consent (for media and certain communications)

Data Use

SASCA will:

  • Collect only necessary personal data

  • Store data securely

  • Use data only for legitimate organisational purposes

Your Rights

Individuals have the right to:

  • Access their personal data

  • Request correction of inaccurate data

  • Request deletion (where applicable)

  • Restrict or object to processing

  • Withdraw consent at any time (where applicable)

Requests can be made in writing to SASCA.

Data Retention

Data will be retained only for as long as necessary for safeguarding, legal, and operational purposes.

16. Agreement

By participating in SASCA activities, participants and guardians confirm they have read, understood, and agree to these Terms and Conditions.
